The cost of contract renegotiation: Evidence from the local public sector

Economic theory claims that contracts renegotiation prevents from reaching the informationally constrained efficient solution that could have been obtained under full commitment. Assessing the cost of renegotiation compared to the full commitment scenario still remains an open issue from an empirical viewpoint. To address this question, we fit a structural principal-agent model with renegotiation on a set of contracts for urban transport services. The model captures two important features of the industry. First, only two types of contracts are used in practice (fixed-price and cost-plus). Second, subsidies are greater when a cost-plus contract was signed earlier on than following a fixed-price contract. We then compare a scenario with renegotiation and a hypothetical situation with full commitment. We conclude that the welfare gains from improving commitment would be significant but would accrue mostly to operators.
La théorie économique affirme que la renégociation des contrats empêche d'atteindre une solution efficace qui peut être obtenue en cas d'engagement complet du régulateur. L'évaluation du coût de la renégociation par rapport au scénario " engagement complet " reste une question ouverte d'un point de vue empirique. Pour répondre à cette question, nous ajustons un modèle structurel principal-agent avec renégociation à un ensemble de contrats de services de transport urbain. Le modèle tient compte de deux caractéristiques importantes de l'industrie. Tout d'abord, seuls deux types de contrats sont utilisés dans la pratique (prix fixe ou coût du service). Ensuite, les subventions sont plus importantes lorsque un contrat de type coût du service a été signé avant un contrat à prix fixe. Nous comparons ensuite le scénario avec renégociation et celui plus hypothétique d'engagement total. Nous concluons que les gains de bien-être issus de l'amélioration de l'engagement seraient importants, mais reviendraient essentiellement aux opérateurs.
