Relations Between the Rotterdam Rules and the CMR

Les relations entre les Règles de Rotterdam et la CMR.

Résumé

The "Convention of Contracts for the International Carrying of Goods Wholly or Partly by Sea", known as the "Rotterdam Rules" is the new ‘maritime +’ international transport convention. This convention governs the international contract of carriage of goods provides for a unique regime for door-to-door transport including a maritime leg. As such, it contains some mutlimodal aspects which could raise potential conflicts with The CMR (Convention on carriage of goods by road, signed in Geneva, May 15th 1956). The aim of this paper is to analyze such conflicts and to propose solutions to the conventional overlaps.
