A regulator of electoral suffrage : the right to vote for fa-thers and heads of families in France and Portugal

Résumé

The right to vote reserved for fathers is a classic theme, since the idea was to exclude “bad citizens”, in contact with human passions and therefore likely to destroy the new representative regimes and the foundations of modern constitutionalism - that is to say : introduce oclocracy. The people rejected are women (recycling the Roman thesis of the imbecillitas sexus), young people (often immature) and single people (for introducing immorality into the public arena). This choice was also intended to confirm the role of the father as a “domestic magistrate”, i.e. a conservative and educational power, similar to the new real power conceived by the Li-berals. In this sense, fathers had to set an example through constitutional education and the reasonable exercise of the vote, with the particularity of representing the rest of the family in elections. This regulation of the electoral system, seeking both to exclude bad citizens and to educate im-mature citizens, was followed by regulation by the corporation at the end of the 19th century. However, within the framework of corporate suffrage, peculiar to corporatism, the spectre of the “fascism of fathers” appeared as early as 1922, which eventually contributed to killing the concept.
O direito de voto reservado aos pais é um tema clássico, uma vez que a ideia era excluir “maus cidadãos”, em contacto com paixões humanas e, portanto, susceptíveis de destruir os novos regimes representativos e os alicerces do constitucionalismo moderno - quer dizer : introduzir a oclocra-cia. As pessoas rejeitadas são mulheres (reciclando a tese romana do im-becillitas sexus), jovens (muitas vezes imaturos) e solteiros (por introduzir a imoralidade no espaço público). Esta escolha destinava-se igualmente a conrmar o papel do pai enquanto “magistrado domestico”, ou seja, um poder conservador e educador, semelhante ao novo poder real concebido pelos Liberais. Neste sentido, os pais tiveram de dar o exemplo através da educação constitucional e do exercício razoável do voto, tendo a particula-ridade de representar o resto da família nas eleições. Esta regulamentação do sistema eleitoral, procurando tanto excluir maus cidadãos como educar cidadãos imaturos, foi seguida da regulação pela corporação no nal do século XIX. Contudo, no quadro do sufrágio corporativo, peculiar ao cor-porativismo, o espectro do “fascismo dos pais de família” aparece já em 1922, o que acabará por contribuir para matar o conceito.
