Controlling IP at War: the US Alien Property Custodian and the German Patents during WWII

Wars constitute a very special context for intellectual property insofar as they lead to a redefinition of economic regulations. This paper intends to analyze the role of the Alien Property Custodian during the Second World War. With the beginning of the new conflict, the APC came into force again, whereas several aspects of intellectual property - and in particular the patent system - had been challenged since the 1930s. Nevertheless, the APC policy on intellectual property was then much more intense than in the previous conflict. It allowed the control or even the dispossession of German IP assets thanks to a well organized administration. We describe the APC structure and we analyze its role in the attempt to reframe the US patent system just after the war.
Les guerres constituent un contexte très particulier pour la propriété intellectuelle dans la mesure où elles conduisent à une redéfinition des règles économiques. Cet article se propose d'analyser le rôle de l'Alien Property Custodian pendant la Seconde Guerre mondiale. Avec le début du nouveau conflit, l'APC entre à nouveau en vigueur, alors que plusieurs aspects de la propriété intellectuelle - et en particulier le système des brevets - avaient été remis en cause depuis les années 1930. Néanmoins, la politique de l'APC en matière de propriété intellectuelle était alors beaucoup plus intense que lors du conflit précédent. Elle permettait de contrôler, voire de déposséder, les actifs de propriété intellectuelle allemands grâce à une administration bien organisée. Nous décrirons la structure de l'APC et nous analyserons son rôle dans la tentative de recadrer le système des brevets américains juste après la guerre.
