Le gouvernement et l’interprétation de la constitution sous le IVème république

Résumé

Under the Fourth Republic, the government occupies an ambiguous place among the constitutional bodies called upon to interpret the Constitution. On the one hand, like any constitutional body having to implement the supreme text, it must interpret the latter. On the other hand, as a body traditionally subordinated to Parliament (according to the classic reading of French parliamentarism of the Third and Fourth Republics), its interpretation is deemed to remain subordinate, too. In fact, the government succeeds in imposing its interpretation of the Constitution on several occasions on the President of the Republic. The government finds itself in a less favorable position with regard to conflicts of interpretation it might have with Parliament. Actually, it has found a solution to this problem by delegating the task of interpreting the Constitution to a technical body, namely the Council of State. Thus, under the Fourth Republic, the government regularly invokes, in support of its positions, the interpretation of the administrative body. Highly promising, this strategy illustrates the tendency of French constitutional bodies not to assume their own power of interpretation of the Constitution and to leave to the judicial bodies an apparent monopoly.
Sous la IVe République, le gouvernement occupe une place ambiguë parmi les organes constitutionnels amenés à interpréter la Constitution. D’une part, comme tout organe ayant à mettre en œuvre le texte suprême, il doit interpréter ce dernier. D’autre part, organe subordonné au Parlement selon la lecture classique du parlementarisme français des IIIe et IVe République, son interprétation est réputée demeurer également subordonnée. Dans les faits, le gouvernement réussit sans peine à imposer son interprétation de la Constitution au président de la République. En ce qui concerne les conflits d’interprétation l’opposant au Parlement, il se retrouve dans une situation moins favorable. Il a toutefois trouvé une solution à ce problème en délégant la tâche d’interpréter la Constitution à un organe en apparence technique : le Conseil d’État. Sous la IVe République, le gouvernement invoque ainsi régulièrement, au soutien de ses positions, l’interprétation de l’organe administratif. Promise à un grand avenir, cette stratégie illustre la tendance des organes constitutionnels français à ne pas assumer eux-mêmes leur pouvoir d’interprétation de la Constitution et à en laisser l’apparent monopole aux organes juridictionnels.
