Résumé
Die Arbeit analysiert 99 Auslegungsmethoden, die in der Rechtsprechung des Europäischen Gerichtshofs und des Europäischen Gerichtshofs für Menschenrechte verwendet werden. Das Fehlen einer vorhersehbaren Anwendung dieser Interpretationstechniken und die Sakralisierung des Rechts wird als JUDIZIELLER SCHAMANISMUS bezeichnet. Die Dissertation gibt einen umfassenden Überblick über kritische und postmoderne Rechtsansätze und bestreitet deren Existenz.
Der letzte Teil der Arbeit stellt die Rechtsphilosophie dar, illustriert von Ronald Dworkin, John Finnis und H.L.A. Hart als Form der kommerziellen Werbung für Justizschamanismus. Es beschreibt 3 Werbestrategien und 21 Werbetechniken der drei Rechtsphilosophen und vergleicht sie mit Durex, IKEA und anderen Werbekampagnen.
The thesis analyses 99 methods of interpretation used in the case law of the EU Court of Justice and the European Court of Human Rights. Absence of any foreseeable application of those interpretative techniques and the sacralization of law is called JUDICIAL SHAMANISM. The thesis provides a comprehensive overview of critical and postmodern approaches to law and denies its existence.
The last part of the thesis presents philosophy of law illustrated by Ronald Dworkin, John Finnis and H.L.A. Hart as a form of commercial advertising for judicial shamanism. It describes 3 advertising strategies and 21 advertising techniques of the three philosophers of law, and compares them to Durex, IKEA and other advertising campaigns.
La thèse analyse 99 techniques d'interprétation utilisées dans la jurisprudence de la Cour de justice de l'UE et de la Cour européenne des droits de l'homme. L'absence de prévisibilité dans l'application de ces techniques interprétatives et la sacralisation du droit sont appelées le CHAMANISME JUDICIAIRE. La thèse donne un aperçu complet des approches critiques et postmodernes du droit et nie son existence.
La dernière partie de la thèse présente la philosophie du droit illustrée par Ronald Dworkin, John Finnis et H.L.A. Hart comme une forme de publicité commerciale pour le chamanisme judiciaire. L'auteur décrit 3 stratégies publicitaires et 21 techniques publicitaires des trois philosophes du droit, et les compare à Durex, à IKEA et à d'autres campagnes publicitaires.
