Sur l'usage des concepts juridiques en histoire

Summary How legitimate is the use by historians of juridical concepts? The author examines this question in the context of François Furet's hypothesis that the king of France had already been entirely removed from power by the end of 1789. This hypothesis is based on two arguments: first, the French Assembly applied the dogma according to which the unity of sovereignty could only reside in the Assembly itself; second, the king's right to a suspensive veto did not make him into partial legislative organ. Neither of these propositions resists examination. The meaning of the concepts of sovereignty and suspensive veto can only be provided by legal theory. The latter reveals, on the one hand, that the Assembly applied, with respect to the question of legislative power, a concept of sovereignty which posed no objection to the establishment of two legislative organs, and, on the other hand, that the right to a suspensive veto in a genuine legislative power.
De même que les sciences sociales se distinguent nettement des faits sociaux, qui constituent leur objet, la science du droit doit être distinguée du droit luimême, entendu soit comme système normatif spécifique, soit comme pratique. Dès lors qu'on examine les rapports du droit et des sciences sociales, on doit se garder de confondre plusieurs types de questions, qui toutes peuvent et doivent être traitées, mais qui relèvent de problématiques très différentes. Il s'agit en premier lieu de la question du rapport entre droit et société, qui concerne l'influence des règles juridiques sur les pratiques sociales et des forces sociales sur le contenu des normes juridiques.
