Algorithm-Based Anticompetitive Unilateral Practices

Résumé

The pricing, ranking, or matching algorithms developed and used by firms can be the carriers of unilateral anticompetitive strategies. The first type of strategy corresponds to exclusionary abuse. The algorithms are then manipulated to prevent competitors from entering the market or to distort competition. The second strategies correspond to exploitative abuses through which firms capable of manipulating the algorithms to their advantage can extract an undue share of the gains associated with the transactions
