Intellectual property strategies using legal astuteness : a new managerial approach of business law
Résumé
This paper, based on Resource and Skill theory, proposes a new way of thinking about business law, more particularly in case of Intellectual Property (IP). We suggest the notion of legal astuteness to explain the tight relation between the managerial decisions of the firm and its IP legal environment. This part envisages the IP law as a contingent component of the strategic project and a group of astuteness to be optimized in the service of the firm conceived as a value chain. Patents and Trademarks Law is articulated both as a new resource for competition and as a tool of value capture.
