Iraqis in Syria. Temporary guest or refugees ?

Since 2003 Syria hosts a large Iraqi community. It is important to note that despite the reception of different waves of refugees, Syria, like most the countries in the region, is neither part of the 1951 Convention nor the 1967 Protocol, and there is no specific memorandum of understanding between UNHCR and the Syrian authorities. Since 2003 Syria has an open-door migratory policy towards Iraqis, considered as Arab citizens, and does not expel them. Since October 2007 measures to restrict the entry and stay of Iraqi refugees have been implemented by the Syrian authorities. Iraqis wishing to enter Syria have to apply for a visa. Only Iraqis entering the country for commercial, transport, scientific and education purposes have obtained visas since the implementation of the visa procedure. Syrian authorities have also put restrictions on access to residency rights, in consequence most Iraqis are considered as temporary guests. Refugees have access to education and health system, with some restrictions due to the large number of Iraqis. All the refugees are located in urban areas. This presentation will discuss the articulation between Syrian migration policy towards Iraqis and the UNHCR policy of protection.
