Recours différenciés au droit et aux tribunaux civils. Étude des représentations et modes de réception de la justice

Abstract : Based on collective interviews, the article highlights the structural dimension of economic, social, and cultural inequalities that plaintiffs and defendants experience facing law and justice. Focus group participants criticize, universally, law and justice as instruments of domination. Men and women interpret gender influence differently, however. They explain differentiated treatment by family law in terms of a lack of time and resources in courts, as well as legal professionals’ stereotyping practices. Contrary to what is seen in criminal justice, participants denote few effects due to a specific nationality or ethnicity except when it comes to a lack of French linguistic skills. Finally, some, not only the “haves,” use the law as an instrument for individual and collective protection.
