The Meiji Era. When Japanese Law Became Positivized

Résumé

The example of the Meiji era in Japan is characteristic of the movement of legal positivization which accompanied the creation of the Nation-States. there, the success of the new conception of law was examplary. Legal technology, imported from the West from the second half of the 19th century, was the vector of a "positivization of the law" in that it was really integrated into the country's intangible and fundamental structures. Even if the Meiji governement intended to modernise Japan only to the extent it was deemed necessary to compete with the world's greatest powers, the Meiji reformers' initial intention became completely overtaken by the reality: it metamorphosed the country and configured the Japan of today.
L'exemple de l'ère Meiji au Japon est caractéristique du mouvement de positivisation du droit qui a accompagné la création des Etats-nations. Le succès de la nouvelle conception du droit y a été exemplaire. La technologie juridique, importée d'Occident à partir de la seconde moitié du XIXe siècle, a été le vecteur d'une "positivisation du droit" en ce qu'elle s'est véritablement intégrée aux structures intangibles et fondamentales du pays. Même si le gouvernement Meiji n'avait l'intention de moderniser le Japon que dans la mesure où cela était jugé nécessaire pour rivaliser avec les plus grandes puissances mondiales, l'intention initiale des réformateurs de Meiji a été complètement dépassée par la réalité : elle a métamorphosé le pays et configuré le Japon d'aujourd'hui.
