MULTILATERALISM AND TRANSNATIONAL LAW: THE EXAMPLE OF SPORT
MULTILATERALISME ET DROIT TRANSNATIONAL : L'EXEMPLE DU SPORT
Résumé
The contribution seeks to shed a "multilateral" light on phenomena of normative production that have already been presented in a different light by means of other legal notions/concepts (transnational law, self-regulation, legal order, co-regulation, global law, etc.). The question is, incidentally, whether this angle of approach, in its quantitative dimension (as law shaped "by many") or qualitative dimension (as a project of international society), is of any help in understanding the regulation of competitive sport or, from another point of view, whether the case of sport is likely to usefully enrich the concept of multilateralism. From this point of view, the self-regulation of the sport movement is considered as a form of private multilateralism (I) and the weak collective intervention of states in the field of sport as a sign of the limits of public multilateralism in this field (II). The development of cooperation between public authorities and international sports organisations in certain areas of common interest nevertheless makes it possible to identify a form of "inclusive multilateralism" in the production of standards (III).
La contribution s’emploie à apporter un éclairage « multilatéral » sur des phénomènes de production normative déjà présentés sous un autre jour au moyen d’autres notions/concepts juridiques (droit transnational, autorégulation, ordre juridique, corégulation, droit mondial etc.). Il s'agit incidemment de déterminer si cet angle d’approche, dans sa dimension quantitative (en tant que droit façonné « à plusieurs ») ou qualitative (en tant que projet de société internationale) , est d’un quelconque apport pour appréhender la régulation du sport de compétition ou, d’un autre point de vue, si le cas du sport est susceptible d’enrichir utilement la notion de multilatéralisme. Dans cette optique, l’autorégulation du mouvement sportif est envisagée comme une forme de multilatéralisme privé (I) et la faible intervention collective des Etats dans le domaine du sport comme le signe d’une limite du multilatéralisme public en ce domaine (II). Le développement de la coopération entre pouvoirs publics et organisations sportives internationales dans certains domaines d’intérêt commun permet néanmoins d’identifier une forme de « multilatéralisme inclusif » dans la production normative (III).
