Conditions d’engagement de la responsabilité de l’Etat d’accueil de l’investissement
Résumé
The responsibility of a State in respect of an investment certainly arises from its internationally wrongful act, i.e. conduct consisting of an act or omission which is attributable to the State under international law and which constitutes a breach of an international obligation of the State". . In addition to the conditions of attribution (I) and breach (II), which although inextricably linked can be conceptually separated, State responsibility will only be established if the wrongful act is not excused by a "circumstance precluding wrongfulness" (III).
La responsabilité de l’État en matière d’investissement résulte assurément de son fait internationalement illicite, à savoir d’un comportement consistant en une action ou une omission qui est attribuable à l’État en vertu du droit international et qui constitue une violation d’une obligation internationale de l’État. » . En sus de la réunion des conditions d’attribution (I) et de violation (II) qui bien qu’inextricablement liées peuvent être conceptuellement séparées , l’engagement de la responsabilité de l’État ne sera établie que si le fait illicite n’est pas excusé par une « circonstance excluant l’illicéité » (III).
